If the case of Patrick Swiney would be the book for a Hollywood-movie, it would be called not believable. Patrick Swiney is a former police officer. After another police officer and a state attorney, who were sentenced to prison for drug dealing because of his work, were free again, Patrick Swiney got threats against his life and the life of his family. In this time it also happened that three men assaulted him and hurt his face seriously with knifes. In December 1987 Patrick Swiney should have, as it was said, killed his wife and her lover in a rage of jealous. The prosecutor against him was, what they call in America the “Highschool-sweatheart” of Patrick Swineys wife. Because of his special request, they made no DNA-Test on her body. A report of a consultant, well known to the state, that shows, that because there was no sign of ……… (do not know the english word yet - but I am sure you know what I want to say) on his hands, it was impossible that he has shot any gun, was never used at the trial or - as the law says - given to the defense. In the years in prison in Alabama Patrick Swiney had three heart attacks. After the first heart attack he was left in his cell without help, till he had the second the next day and he was brought to hospital. At the hospital his mother and sister were able to hear outside the room two guards threating Patrick Swineys life. But the proceeding against the two guards was stopped. Not only does he have a heart illness, he also suffers spinal arthritis.
In the last years Patrick Swiney wrote a lot of articles. One of them “Too Late To Debate???” from the year 1998 tells about the untenable conditions in the Holman prison and brought him a lot of troubles. Since them suffers because of punishments without reasons and restrictions of his personal contacts, like disappearing of his in- and outgoing mail. After the former leader of the prison department had offered him in a letter in the year 1996 to help him when he finds a country that is willing to give him political asyl, Patrick Swiney and his supporters contact politicians and persons all over the world. Some of them contacted the prison department of Alabama and that made the personal little war between Patrick Swiney and the warden of Holman bigger.
On November 30. 2001, Patrick Swiney was able to call his wife, before he was moved without a warning to the Kilby prison. The following weekend, nobody in that prison was able to tell his family if he was really there, how he was doing and if he had his medicine with him. The Kilby prison is made for prisoners who wait to be brought to another prison. There are three prisons in Alabama, that house prisoners with LWOP. Holman, that he just has left, St. Clair and West Jefferson. Patrick already was in St. Clair and West Jefferson and there he - the former policeman - was attacked by other prisoners. A life in one of those prisons would force him - for his own safety - to life a life in a bathroom-size cell without any human contact.
A member of his investigation teams was able to learn, that Patrick Swiney was really there. The warden of the Holman prison himself had requested that Patrick Swiney was moved. He was told, that Patrick Swiney has his medicine and is doing well.
Some days later, Patrick Swiney was able to call his mother. They have taken away all his medicine and the mattress in his cell was so bad, that he prefears to sleep on the floor - even he has athritis. After a request at the prison, they told, that they took away all the medicine, because it was not from the prison. They never changed his mattress, even there were a lot of protest letters and calls and he never got his medicine, that could save his life and make it easier, back.

Schwerkranker Gefangener wird in Alabama unnötig gequält
Der Fall des Patrick Swiney würde, wäre er das Drehbuch für einen Hollywood-Film, als zu unglaubwürdig eingestuft werden. Patrick Swiney ist ein ehemaliger Polizist. Nachdem ein Polizist und ein Staatsanwalt, die durch seine Arbeit wegen Drogenhandels verurteilt worden sind, wieder auf freiem Fuß waren, erhielt Patrick Swiney Drohungen gegen sein Leben und das Leben seiner Familie. In dieser Zeit geschah es auch, dass drei Männer ihn überfielen und sein Gesicht mit Messern schwer verletzten. Im Dezember 1987 soll Patrick Swiney in einem Anfall von Eifersucht seine Frau und deren Liebhaber erschossen haben. Der gegen Patrick Swiney die Anklage betreibende Staatsanwalt war das, was man in America das "Highschool-sweetheart" von Patrick Swineys Ehefrau nannte. Auf sein Betreiben hin wurde an ihrer Leiche kein DNA-Test durchgeführt. Ein der Staatsanwaltschaft bekannter Bericht eines Gutachters darüber, dass es aufgrund fehlender Schmauchspuren an Patrick Swineys Händen unmöglich gewesen sein kann, dass er eine Schußwaffe abgefeuert hat, wurde vor Gericht nicht verwendet und auch entgegen der geltenden Gesetze nicht an seine Verteidigung weitergeleitet. In den Jahren im Gefängnis von Alabama erlitt Patrick Swiney drei Herzinfarkte. Nach dem ersten Herzinfarkt ließ man ihn unbehandelt in seiner Zelle liegen, bis er am nächsten Tag den zweiten hatte und man ihn ins Spital brachte. Im Spital konnten seine Mutter und seine Schwester vom Gang aus mitanhören, wie zwei Wärter Patrick Swiney damit bedrohten, ihn gleich hier zu erschiessen. Natürlich wurde das Verfahren gegen die beiden Wärter eingestellt. Zusätzlich zu seiner Herzerkrankung leidet er an einer spinalen Arthritis.
In den letzten Jahren schrieb Patrick Swiney viele Artikel. Einer davon, "Too Late To Debate???" aus dem Jahr 1998 beschreibt die unhaltbaren Zustände im Gefängnis Holman und brachten ihm deshalb dort jede Menge Ärger ein. Seither leidet er ständig unter unbegründeten Strafmaßnahmen und Einschränkungen seiner Kontakte, wie dem Verschwinden seiner ein- und ausgehenden Post. Nachdem der damalige Leiter der Gefängnisverwaltung von Alabama im Jahr 1996 schriftlich angeboten hatte, ihm zu helfen, wenn er ein Land finden würde, das ihm politisches Asyl gewährt, kontaktierten Patrick Swiney und seine Unterstützer Politiker und wichtige Persönlichkeiten der ganzen Welt. Einige davon wendeten sich an die Gefängnisverwaltung in Alabama und dies verstärkte den Kleinkrieg zwischen Patrick Swiney und den Gefängnisdirektor von Holman noch mehr.
Am 30. November 2001 konnte Patrick Swiney seine Frau gerade noch anrufen, bevor er ohne Vorwarnung in das Kilby-Gefängnis verlegt wurde. Das gesamte darauffolgende Wochenende war man in diesem Gefängnis nicht in der Lage, seiner Familie zu sagen, ob er wirklich dort war, wie es ihm geht und ob er seine Medikamente bei sich hat. Das Kilby-Gefängnis ist nur dafür gedacht, dass Gefangene dort auf ihren Transport in ein anderes Gefängnis warten. Es gibt in Alabama nur drei Gefängnisse, in denen Gefangene untergebracht sind, die zu einer lebenslangen Gefängnisstrafe ohne Bewährungsmöglichkeit verurteilt worden sind. Eines ist Holman, aus dem er gerade verlegt worden ist, die anderen beiden sind St. Clair und West Jefferson. Sowohl in St. Clair als auch in West Jefferson war Patrick Swiney bereits untergebracht und in beiden Gefängnissen wurde er - der ehemalige Polizist - von Gefangenen attackiert. Ein Leben in einem der beiden Gefängnisse würde ihn - zu seiner eigenen Sicherheit - zu einem Leben in einer badezimmergroßen Zelle ohne jeglichen menschlichen Kontakt zwingen.
Einem Mitarbeiter des Ermittlungsteams, das für Patrick Swiney arbeitet, war es dann möglich zu erfahren, dass er sich dort befindet. Der Direktor des Holman Gefängnisses selbst hätte beantragt, dass man Patrick Swiney verlegt. Man erklärte, dass Patrick Swiney seine Medikamente hätte und es ihm gut ginge.
Einige Tage später konnte Patrick Swiney seine Mutter anrufen. Man hatte ihm alle seine Medikamente weggenommen und die Matratze seiner Zelle wäre dermaßen schlecht, dass er es - trotz seiner Athritis - bevorzuge, auf dem Boden zu schlafen. Eine Nachfrage im Gefängnis ergab, dass man ihm die Medikamente weggenommen hatte, weil er sie nicht in diesem Gefängnis bezogen hätte. Die Matratze wurde trotz zahlreicher Protestanrufe und -schreiben nicht ausgetauscht und vor allem hat er seine Medikamente, die sein Leben retten und erleichtern könnten, bis heute nicht erhalten.
